Fight sports remain the loudest example — near-identical records drawing opposite conclusions across filings, documented in the firm's combat-sports alert. The practical response is not outrage but construction: filings built assuming the tougher officer, with the comparable-evidence argument made explicitly rather than left for the RFE round.
Two climate facts every 2026 filing should assume. First, under current USCIS policy a denial can arrive without an RFE — the front-loading discipline is no longer optional. Second, renewals are being read for CURRENT acclaim, not history — second filings deserve first-filing evidence.
The whole pattern set reduces to one instruction: build the file to answer the questions before they are asked — the checklist is that instruction expanded. For the file already holding a request, the RFE page; for the file already denied, the four roads.
We publish patterns we can substantiate from our own filings, not rates — and the honest qualitative read is that scrutiny styles shift more than raw outcomes. Build for the tougher officer either way.
